By accessing or using the Hyper Studios website (the "Site") or engaging Hyper Studios ("we," "us," "our") for development services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site or our services.
You agree to use the Site and our services only for lawful purposes. You may not:
Unless otherwise agreed in a signed project agreement, all content on the Site — including text, graphics, logos, and the Site's design — is the property of Hyper Studios and may not be copied, reproduced, or distributed without our written permission. Custom deliverables built for a specific client (plugins, builds, bots, sites) are governed by the intellectual property terms in that client's individual service agreement, not by these general Terms.
Where no separate signed project agreement says otherwise, Hyper Studios retains the right to reuse, adapt, and showcase — including in our public portfolio, on the Site, and in our Discord server — any code, configuration, or other assets we develop while completing a commission, even after the finished deliverable has been provided to the client. This does not transfer ownership of, or grant us any right to use, the client's own proprietary content, branding, or data supplied to us for the project.
These Terms cover use of the Site itself. Actual development work — server builds, plugins, Discord bots, websites, and related services — is governed by a separate, project-specific agreement between Hyper Studios and the client, covering scope, deliverables, timeline, and payment. Nothing on this Site constitutes an offer to perform services; a quote becomes binding only once both parties agree to a written scope.
The Site and any general information on it are provided "as is," without warranties of any kind. To the fullest extent permitted by law, Hyper Studios is not liable for any indirect, incidental, or consequential damages arising from your use of the Site — including damages related to server downtime, data loss, or third-party platform changes (e.g. Minecraft or Discord API updates) affecting delivered work — except as otherwise stated in a specific project agreement.
We may update these Terms from time to time. Changes take effect when posted to this page, and the "Last updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
These Terms are governed by the laws of United States, without regard to conflict-of-law principles.
